No. Since 2010 there has been a legal ban on smoking in all festival tents without smoking areas. Smoking takes place outside – in front of the tent, in the beer garden or in the open spaces.
Is smoking allowed at Oktoberfest?
Yes – but not inside the tent. Smoking is allowed in the open areas of the Theresienwiese, in front of the tents, and in the beer gardens. As soon as you enter a festival tent, Bavaria’s smoking ban applies without exception. Anyone who lights up indoors risks a fine and, even more immediately, being thrown out by the tent staff.
For your time in the tent, that means: every cigarette means a trip outside, and if the tents are full, re-entry isn’t guaranteed. E-cigarettes and vapes are affected in pretty much the same way. Inside the tent itself, there’s really only one nicotine option: Snus and tobacco-free Nicotine Pouches. These small Pouches are placed under your lip and produce neither smoke nor vapor. That’s why they fall under neither the smoking ban nor the venue rules enforced by the tent operators – and your seat on the beer bench stays yours. Where can you smoke at the Wiesn?
In short: anywhere outdoors. In front of the tents, in the festival tents’ beer gardens, and on the walkways around the grounds, smoking is allowed. Two things you should keep in mind: the Wiesn is a family-friendly event – so be considerate in crowded areas. And cigarette butts belong in ashtrays, not on the festival grounds.
Does the ban also apply to e-cigarettes and vapes?
Legally, vaping is not clearly covered by Bavaria’s smoking ban. In practice, though, that makes no difference: tent operators ban e-cigarettes in their tents under their venue rules. If you want to vape, you’ll have to do the same as smokers – head outside.
The smoke-free alternative inside the tent: Snus and Nicotine Pouches

There’s no legal issue either: consuming Snus and nicotine pouches is not prohibited in Germany – only the sale of tobacco Snus is banned. So you can also use your own Pouches inside the tent; however, if you’re carrying tobacco-containing Snus, only bring quantities that can credibly be considered for personal use.

Background: Since when has the Wiesn been smoke-free?
The smoking ban at Oktoberfest is not a house rule set by the tent operators, but the law: In the referendum held in the summer of 2010, Bavarians voted for strict non-smoker protection. Since then, indoor areas in the hospitality sector – festival tents explicitly included – have been smoke-free. At the “Übergangswiesn” in 2010, violations were not yet penalized, but since 2011 the ban has been enforced. There are no smoking rooms in the tents. A little fun fact: As early as 2008, some smaller tents voluntarily led the way and stayed smoke-free on weekdays until 6 p.m. – Wiesn was one step ahead of the law.
Please note: Snus and Nicotine Pouches contain nicotine and carry a risk of addiction. The absence of tobacco smoke makes them a harm-reduction alternative compared to cigarettes — not a product that is harmless to health.
